LILFUN SPORTS – TERMS & CONDITIONS

Welcome to LILFUN SPORTS.

These Terms & Conditions govern your use of the LILFUN SPORTS website and your enrolment of a child in any LILFUN SPORTS programme.

By accessing the Site and/or submitting an enrolment form, you agree to be bound by these Terms & Conditions in full. If you do not agree to these Terms & Conditions, you must not use the Site or enrol a child in any of our programmes.

The LILFUN SPORTS Site is intended for personal use only. Use of the Site for commercial, illegal or unauthorised purposes is strictly prohibited.

You must be at least 18 years of age to use the Site or enrol a child in our programmes. By using the Site or submitting an enrolment, you confirm that you meet this requirement.

These Terms & Conditions apply to the use of the Site and all enrolments made with LILFUN SPORTS ("LILFUN SPORTS", "we", "us" or "our").

1. ABOUT US

LILFUN SPORTS provides multi-sport programmes for children, delivered by a team of experienced physical educators, coaches and athletes.

2. ELIGIBILITY

To enrol a child in a LILFUN SPORTS programme, you must:

(a) be at least 18 years of age;

(b) be the child's parent or authorised legal guardian, or otherwise have the necessary legal authority and/or consent to enrol the child and provide the information and authorisations required by LILFUN SPORTS; and

These requirements must be met cumulatively.

Where an enrolment or consent form is completed by one parent or legal guardian, LILFUN SPORTS will rely on that person's representation that they have the legal authority and/or any necessary consent to enrol the child and provide the relevant information and authorisations.

3. SPORTS PROGRAMME INFORMATION

LILFUN SPORTS provides structured, age-appropriate multi-sport and physical activity programmes designed to introduce children to a variety of sports, movement activities, games and challenges in a fun, active and supportive environment.

The programme may include a range of different sports and activities throughout the season and follows a multi-sport approach rather than focusing exclusively on one sport.

Sessions are planned and delivered by coaches with relevant experience and/or qualifications in sport, physical education and working with children.

Every reasonable effort is made to ensure that programme descriptions, schedules, prices and other information displayed on the Site are accurate and current. However, information may be amended from time to time.

5. ENROLMENT & PAYMENT

To secure a place in a LILFUN SPORTS programme, you must submit the applicable online enrolment form and complete the required payment via our secure third-party payment processor once a payment link has been provided.

An enrolment is only considered confirmed once you receive confirmation from LILFUN SPORTS.

Any automated email, receipt or other communication received directly from a third-party payment processor does not, by itself, constitute confirmation of the child's enrolment.

We reserve the right to reject or cancel an enrolment where reasonably necessary, including in cases involving payment issues, incorrect or incomplete information, programme capacity limitations and/or suspected misuse.

6. THIRD-PARTY SERVICES

Third-party service providers, including payment providers, operate under their own terms, conditions and privacy policies.

LILFUN SPORTS is not responsible for the independent practices of such third-party providers. You are encouraged to review their applicable terms and privacy policies before using their services.

7. ENROLMENT CANCELLATION BY LILFUN SPORTS

LILFUN SPORTS reserves the right to cancel an enrolment prior to confirmation.

Where payment has already been received and LILFUN SPORTS cancels the enrolment prior to confirmation, a full refund will be issued to the same payer using the applicable payment method where possible.

8. REFUNDS

Refunds are issued where a programme or enrolment is cancelled by LILFUN SPORTS prior to confirmation.

Except where otherwise required by applicable law or expressly provided for in these Terms & Conditions, any other refund request will be considered at the discretion of LILFUN SPORTS.

Where a child is refused participation in a particular session because required essential medication has not been provided, LILFUN SPORTS will not be obliged to refund the missed session.

9. PRICING POLICY

All prices are stated in Euro (€).

Prices may be amended from time to time. Any price change will apply prospectively and will not affect an enrolment that has already been confirmed at the previous price.

10. LIMITED LICENCE TO USE THE SITE

LILFUN SPORTS grants you a limited, revocable and non-exclusive licence to access and use the Site for personal purposes.

You may not reproduce, republish, copy, distribute, modify or otherwise exploit Site content for commercial purposes without prior written permission from LILFUN SPORTS.

11. ACCEPTABLE USE

You agree not to misuse the Site.

This includes, without limitation, using the Site for unlawful purposes, attempting to interfere with its functionality or security, uploading unlawful or malicious material, or attempting to gain unauthorised access to any part of the Site or its systems.

12. THIRD-PARTY LINKS

The Site may contain links to external websites or services operated by third parties.

LILFUN SPORTS does not control and is not responsible for the content, availability, terms, privacy practices or operation of third-party websites or services.

13. NO WARRANTIES

While reasonable efforts are made to maintain the Site and ensure that information is accurate, LILFUN SPORTS does not guarantee that access to the Site will always be uninterrupted, error-free or free from technical issues.

14. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, LILFUN SPORTS shall not be liable for indirect or consequential losses resulting from the use of the Site or our services.

Nothing in these Terms & Conditions is intended to exclude or limit any liability which cannot lawfully be excluded or limited under applicable law.

15. INDEMNITY

To the fullest extent permitted by applicable law, you agree to indemnify LILFUN SPORTS against losses, claims, costs or expenses arising from your breach of these Terms & Conditions.

16. BREACHES

Where you breach these Terms & Conditions or misuse the Site, LILFUN SPORTS reserves the right to take reasonable action, including restricting or suspending access to the Site or relevant services.

17. ENROLMENT INFORMATION

You confirm that all information provided to LILFUN SPORTS in connection with an enrolment is accurate, truthful, complete and up to date.

You are responsible for informing LILFUN SPORTS promptly of any material changes to information previously provided.

LILFUN SPORTS reserves the right to refuse service, suspend participation or terminate an enrolment where information provided is found to be materially inaccurate, false, misleading and/or outdated.

18. CHANGES TO THESE TERMS

LILFUN SPORTS may update these Terms & Conditions from time to time.

Any updated Terms & Conditions will be published on the Site. Continued use of the Site following publication of updated Terms & Conditions constitutes acceptance of the revised terms, subject to applicable law.

19. APPLICABLE LAW & DISPUTE RESOLUTION

These Terms & Conditions are governed by the laws of Malta.

Any dispute arising directly or indirectly out of or in connection with LILFUN SPORTS shall be referred to and resolved by arbitration in Malta, subject to any rights or remedies which cannot lawfully be excluded under applicable law.

20. APPLICATION FORM – CONSENT & WAIVERS

20.1 Sport / Activity Information

By submitting an application, enrolment or consent form, the parent/legal guardian gives consent for the child to participate in the LILFUN SPORTS multi-sport programme and the physical activities delivered as part of the programme.

LILFUN SPORTS provides structured, age-appropriate physical activity sessions designed to introduce children to a variety of sports, movement activities, games and challenges in a fun, active and supportive environment.

Children are generally organised into the following age groups:

Little Stars: Ages 3–5
Junior: Ages 6–8
Maxi: Ages 9–12

Throughout the programme, children may participate in a variety of sports and physical activities through planned rotations.

The programme aims to develop fundamental movement and sport skills, coordination, balance, agility, fitness, teamwork, confidence and cooperation while encouraging children to remain active and develop a positive relationship with sport and physical activity.

All sessions are delivered within a group-based setting, with coaches supervising and supporting the group as a whole. LILFUN SPORTS does not provide individual one-to-one support.

20.2 Risk Acknowledgement & Medical Declaration

By submitting the application, enrolment or consent form, the parent/legal guardian acknowledges that participation in sports and physical activities involves inherent risks, including the possibility of accidents and injury.

While LILFUN SPORTS and its coaches take reasonable precautions to provide a safe and appropriately supervised environment, the parent/legal guardian understands and accepts that some risks are naturally associated with physical activity and gives consent for the child to participate in the LILFUN SPORTS programme.

The parent/legal guardian confirms that, to the best of their knowledge, the child is physically able to participate and that all relevant information regarding medical conditions, allergies, injuries, additional needs or other circumstances that may affect the child's safe participation has been disclosed to LILFUN SPORTS.

Where "N/A" or an equivalent declaration is provided in the medical information section, the parent/legal guardian confirms that the child does not suffer from any allergies, medical conditions and/or injuries of which LILFUN SPORTS should be made aware.

LILFUN SPORTS must be informed promptly of any change to the child's health, medical condition or other relevant circumstances during the programme.

20.3 Liability Waiver, Assumption of Risk & Indemnity

By submitting the application form and agreeing to these Terms & Conditions, the parent/legal guardian acknowledges and understands that participation in LILFUN SPORTS activities involves inherent risks, including physical injury, property damage or other losses.

The parent/legal guardian accepts and assumes such inherent risks on behalf of the child arising from participation in the activities.

To the fullest extent permitted by applicable law, the parent/legal guardian releases, waives and discharges LILFUN SPORTS, its owners, directors, officers, employees, agents, volunteers and affiliated parties ("Released Parties") from liability for claims, demands, causes of action, damages, losses, costs or expenses arising from or related to the child's attendance or participation in the programme, subject always to any liability which cannot lawfully be excluded or limited.

To the fullest extent permitted by applicable law, the parent/legal guardian agrees to indemnify and hold harmless the Released Parties from claims, actions, proceedings, costs, expenses, damages and liabilities arising from the child's participation in LILFUN SPORTS activities or a breach of these Terms & Conditions.

Nothing in this section shall exclude or restrict liability where such exclusion or restriction is prohibited by applicable law.

20.4 Medical Information & Essential Medication

Parents/legal guardians are responsible for providing complete and accurate information regarding any allergies, medical conditions, injuries, additional needs or other health-related information relevant to the child's safe participation.

If the child requires an inhaler or other essential medication, it must be brought with the child to each session and be available for use when needed.

Parents/legal guardians are responsible for ensuring that any required medication is provided as necessary.

Failure to provide required essential medication may result in the child being refused participation in the programme on the relevant day. In such circumstances, LILFUN SPORTS will not be obliged to issue a refund for the missed session.

20.5 Medical Authorisation

In the event of an accident, injury or medical emergency, the parent/legal guardian authorises LILFUN SPORTS staff to provide appropriate first aid and, where necessary, contact emergency medical services.

If the parent/legal guardian or emergency contact provided cannot be reached, the parent/legal guardian authorises LILFUN SPORTS to take reasonable and necessary steps to ensure the child receives appropriate medical attention.

Any medical treatment provided by healthcare professionals will be determined by the relevant medical personnel. The parent/legal guardian accepts responsibility for any expenses that may arise in connection with such treatment.

20.6 Drop-Off, Pick-Up & Supervision

Children must be dropped off and collected punctually from the designated drop-off and pick-up area.

Parents/legal guardians are responsible for ensuring that their child arrives safely at the programme.

LILFUN SPORTS' supervision applies during the scheduled session period and ends immediately upon conclusion of the scheduled session.

Parents/legal guardians are responsible for collecting their child promptly at the designated collection point.

If someone other than the authorised parent/legal guardian will collect the child, the Head Coach must be informed in advance by the authorised parent/legal guardian and provided with the full name and identity card number of the person who will collect the child.

Any change to the usual collection arrangements must be communicated to the Head Coach in advance.

If a parent/legal guardian is unexpectedly delayed, the Head Coach must be contacted as soon as possible.

To the fullest extent permitted by applicable law, LILFUN SPORTS shall not be responsible for any loss, damage, injury and/or accident occurring outside the allocated session time, including before the scheduled start time or after the scheduled end time, where the child is not under LILFUN SPORTS' supervision.

20.7 Code of Conduct & Programme Rules

By submitting the application, enrolment or consent form, the parent/legal guardian agrees that:

The child will follow the rules, instructions and guidance provided by LILFUN SPORTS coaches and staff at all times.
Persistent disruptive, disrespectful, inappropriate or unsafe behaviour may result in the child being temporarily or permanently removed from an activity or session.
In serious or repeated cases, LILFUN SPORTS reserves the right to discontinue the child's participation in the programme.
Any fees for remaining sessions following discontinuation will be handled in accordance with these Terms & Conditions and the applicable Refund Policy.
The parent/legal guardian agrees to comply with reasonable programme policies and procedures communicated by LILFUN SPORTS.

20.8 Photo & Video Consent

During LILFUN SPORTS sessions, photographs and/or videos may be taken to capture activities, participation and positive moments from the programme.

Parents/legal guardians will be provided with separate choices regarding:

Parent WhatsApp Group: consent for photographs and/or videos of the child to be shared privately within the relevant LILFUN SPORTS parent WhatsApp group.

LILFUN SPORTS Social Media: consent for photographs and/or videos of the child to be used on official LILFUN SPORTS social media platforms for promotional and awareness purposes.

Consent for one purpose does not automatically constitute consent for the other.

Children's names or other identifying personal information will not be published alongside photographs or videos unless separately authorised where appropriate.

20.9 Parent / Legal Guardian Authority

Where an application, enrolment or consent form is completed or signed by one parent or legal guardian, LILFUN SPORTS will rely on that person's representation that they have the legal authority and/or any necessary consent to provide the information and authorisations contained in the form on behalf of the child.

By submitting the form, the parent/legal guardian confirms that, to the best of their knowledge, there are no court orders, custody agreements, legal restrictions or other circumstances preventing them from providing such authorisation or consenting to the child's participation in the programme.

LILFUN SPORTS will not be responsible for any dispute, disagreement, claim or conflict between parents, guardians or other persons having parental responsibility or rights in relation to the child.

The parent/legal guardian submitting the form is responsible for informing LILFUN SPORTS promptly of any change in custody arrangements, court orders or other legal restrictions affecting the child.
